General Terms and Conditions (GTC)

for the online sale of tickets and vouchers by

1. Scope of application

These General Terms and Conditions (GTC) apply to all orders placed via the

GO! online shop and are intended to supplement the basic General Conditions of Carriage of GO!

The online shop is intended exclusively for consumers. A consumer is any natural

person who enters into a legal transaction for purposes that are predominantly neither commercial

nor self-employed.


2. Subject matter of the contract

The subject matter of the contract is the electronic sale of GO! services.

It is expressly pointed out that not all services available through GO! can also be booked online.

GO! may unilaterally change service descriptions, provided that the respective change is reasonable for

the customer because it is minor and objectively justified. GO! will inform the customer of such changes to the

service description in writing.


3. Conclusion of contract

The presentation of products in the online shop does not constitute a legally binding offer.

By completing the order process, the customer submits a binding offer to purchase the

selected services. The contract is concluded upon receipt of the order confirmation by email. 


4. Prices and payment terms

All prices are quoted in US dollars and include sales tax.

The following payment methods are available:

  • Credit cards (Visa, Mastercard)


Billing takes place immediately after the order is completed.

The tickets or vouchers will be provided electronically (as a PDF via email or as a download link) after successful payment. 


5. Cancellation Protection Upgrade

5.1. Purchase

You can add cancellation protection when purchasing tickets; it is not possible to book cancellation protection at a later date.


5.2. Cancellation and deadline

Cancellation or modification of your order is only possible if you have selected the

cancellation protection upgrade. This allows the booking to be canceled free of charge up

to five days before the first day of validity. Changes without this upgrade or after the deadline are not possible.


5.3. Credit note

In the event of cancellation, you will receive the value of the booked tickets in the form of a voucher. 


6. Delivery of products

Delivery is exclusively digital. The customer will receive a link to download the tickets or vouchers and

an email confirmation. Use requires presentation of the digital or printed ticket at the mountain railway access point.


7. Validity and redemption

7.1 Tickets

Tickets are only valid on the printed date of validity or within the period specified on the ticket. Subsequent changes are not permitted.


7.2 Vouchers

Vouchers are valid for three years from the date of issue (§ 195 BGB). Cash payment, even in partial amounts, is excluded.

The voucher is transferable but may not be resold commercially.


8. No right of withdrawal for tickets

According to § 312g para. 2 no. 9 BGB, there is no right of withdrawal for contracts for the provision of leisure

activities if the contract provides for a specific date or period for the provision.

Therefore, withdrawal or cancellation of ticket purchases is not possible.

For gift certificates, the statutory right of withdrawal of 14 days applies, provided that the gift certificate

has not yet been redeemed. For details, please refer to the separate cancellation policy.


9. Terms of use for the mountain railway 

Use of the mountain railway is subject exclusively to the conditions of carriage, which are displayed at

the stations and can be viewed online. (https://www.goofterschwang.de/Befoerderungsbedingungen.html)

Operating hours, safety regulations, and weather conditions must be observed. In the event of force majeure

or weather-related cancellations, there is no entitlement to compensation or refunds, unless otherwise specified. 


10. Traveling without a valid ticket – Increased transportation fee

Use of the mountain railway is only permitted with a valid ticket.

(1) A passenger is obliged to pay an increased transportation fee if he or she

a) has not obtained a valid ticket.

b) has obtained a valid ticket but is unable to present it for inspection inspection.

c) did not validate the ticket or did not have it validated immediately upon passing through the barrier or inspection.

d) does not present the ticket for inspection upon request.

e) uses a ticket unlawfully or is found with a forged ticket. 

The right to report the matter to the criminal or administrative authorities is reserved. Provisions a and c shall not apply if the ticket

was not purchased or validated for reasons beyond the passenger's control.

(2) The increased fare referred to in paragraph (1) is twice the fare for that journey, but at least €50.00!

(3) In the case of No. (2), the increased fare is reduced to a surcharge of €7.00 if the passenger proves to the railway company within one week of the

date of detection that he or she was in possession of a valid ticket at the time of detection.

(4) Any further claims remain unaffected.


11. Liability

GO! is liable in accordance with the applicable mandatory statutory provisions.


12. Data protection

The collection, processing, storage, and use of passengers' personal data is carried out in accordance with data protection regulations.

To ensure the safety of passengers and cable car operations, and to prevent misuse of passenger tickets, the access areas and cable

car cabins are also monitored by video surveillance from time to time. This is indicated by signs. Passengers agree to video surveillance

and the recording of images. The recording is carried out exclusively for the purpose of protecting property rights and operational safety interests.

This data will be deleted immediately, at the latest after 24 hours, if it is no longer required to achieve the purpose. The relevant provisions

of the Federal Data Protection Act are complied with.

13. Applicable law, place of performance, and jurisdiction

The law of the Federal Republic of Germany applies, excluding the UN Convention on Contracts for the International Sale of Goods.

The place of performance is the registered office of the railway company.

The place of jurisdiction for all legal actions against the railway company is the registered office of the railway company.


14. Final provisions

Should individual provisions of these General Terms and Conditions be or become invalid in whole or in part,

the validity of the remaining provisions shall remain unaffected. The invalid clause shall be replaced by the statutory provision.
